Checks and balences

Hi, I was wondering what kinds of checks and balances are there in the Palestinian governing system? What kind of procedures are needed in order to pass laws or make big decisions. I'd love to hear what people have to say. Thanks.

Hi Gabi,

I found this on the net: Constitution of Palestine (2003). I do not know whether it is just a draft or is a formal legal document.

I am not an expert, however, here is some possibly irrelevant trivia:

My recollection and understanding now is that in 1992(?) a Constitution was drafted for Palestine by a team of lawyers under the auspices of the International Commission of Jurists. That team was led by an Australian lawyer and included at least one other Australian.

That draft constitution, interestingly enough, was initially based on the Constitution of New South Wales which is based on English Common Law. Why? Because it was a start and was something with which these lawyers were familiar. A (modified?) version of the draft they produced was then considered by (some of?) the Palestinians. I do not know whether any of it was really accepted for formal acceptance discussions. I seem to recall being told that Yasser Arafat was not happy then with some aspects of that draft for it threatened his authority.

I do not know whether the Constitution of Palestine (2003) is in any way related to that earlier draft. If anyone is interested, I can talk to one of those lawyers to find out more.

Not enough!
Certainly not enough to prevent one group of Palestinians
from throwing members of another, off of a few Gaza rooftops and balconies.
Not enough to ensure that whoever committed those murders would be prosecuted.
Not enough to ensure the prosecution of anyone charged with killing their sister or daughter
or cousin over a perceived slight to family "honor."
Not enough to keep the last Christian bookseller in Gaza alive.
Not enough to prevent the lynching of alleged collaborators,
nor enough to decriminalize their attempts at nothing more than peaceful coexistence.

But there is a law making it a death penalty crime to sell land to a Jew.
